1. Taraflar ve kabul

Bu koşullar, Miniq Games mobil uygulamasını (“Uygulama”) sunan Berkay Özgeldi (“biz”) ile Uygulamayı kullanan sen arasındadır. Uygulamayı kullanarak ya da hesap açarak bu koşulları ve Gizlilik Politikası’nı kabul etmiş olursun.

2. Hizmet

Miniq Games, aynı odada yüz yüze oynanan parti oyunları sunar (ör. Vampir Köylü, Dilimin Ucunda, Bomba İmha, Batak, Tavla, Liman Kapışması). Misafir olarak ya da hesap açarak oynayabilirsin. Oyunların çoğu çalışmak için internet bağlantısı ve sunucularımız gerektirir.

3. Hesap

• Hesap açmak için en az 13 yaşında olmalısın.
• Kullanıcı adın benzersizdir ve sonradan değiştirilemez. Başkasının adını, marka adlarını, hakaret, nefret söylemi ya da müstehcenlik içeren adları kullanamazsın; böyle bir adı değiştirmeni isteyebilir ya da hesabı kapatabiliriz.
• Giriş bilgilerini korumak senin sorumluluğundadır. Hesabının izinsiz kullanıldığını düşünürsen bize yaz.
• Hesabını istediğin an Ayarlar → Hesabı sil ile silebilirsin.

4. Kullanım kuralları

Şunları yapmamayı kabul edersin:

• görünen adlarda ya da oyun içinde başkalarını taciz etmek, tehdit etmek veya hakaret etmek;
• hile yapmak, oyunun gizli bilgisine erişmeye çalışmak, sunucularımıza aşırı yük bindirmek, oda kodlarını tahmin etmeye çalışmak, güvenlik önlemlerini aşmak;
• Uygulamayı kanunun izin verdiği durumlar dışında tersine mühendislikle çözmek, kopyalamak ya da ticari amaçla dağıtmak;
• Uygulamayı hukuka aykırı bir amaçla kullanmak.

Oyunlar yüz yüze tartışmaya dayanır; odadaki davranışından sen sorumlusun.

5. Miniq Games Plus

• Ne sunar: Plus, bazı oyunlarda ek içerik açan isteğe bağlı bir aboneliktir (ör. Bomba İmha’da ek seviyeler, Dilimin Ucunda’da ek kategoriler). Ücretsiz sürümdeki hiçbir şey Plus’a taşınmaz. Plus’ın kapsadığı içerik zamanla genişleyebilir veya değişebilir.
• Oda: odayı Plus’lı biri kurduysa, o odadaki herkes Plus içeriğiyle oynar.
• Plan ve fiyat: Plus yıllık bir otomatik yenilenen aboneliktir. Güncel fiyat, satın almadan önce App Store’da gösterilir.
• Ücretsiz deneme: yeni aboneler 7 günlük ücretsiz deneme kullanabilir. Deneme bitmeden en az 24 saat önce iptal etmezsen abonelik başlar ve yıllık ücret alınır.
• Otomatik yenileme: ödeme, satın almayı onayladığında Apple Kimliği hesabından alınır. Abonelik, dönem bitmeden en az 24 saat önce iptal edilmezse aynı süre ve o anki fiyattan kendiliğinden yenilenir; yenileme ücreti dönem bitmeden önceki 24 saat içinde alınır.
• İptal: aboneliğini App Store → Abonelikler’den yönetebilir ve iptal edebilirsin. İptal ettiğinde Plus ödenmiş dönemin sonuna kadar sürer. Hesabını silmek aboneliği iptal etmez.
• İade: satın almaları Apple yapar; iade talepleri Apple’ın kurallarına göre reportaproblem.apple.com üzerinden yapılır. Tüketici mevzuatından doğan hakların saklıdır.
• Hesap gerekir: Plus hesabına bağlıdır; misafir olarak satın alınamaz. Başka cihazda aynı hesapla girip “Satın alımları geri yükle” ile geri alabilirsin.

6. Fikri mülkiyet

Uygulama, oyunlar, görseller, sesler, metinler ve kart içerikleri bize ya da lisans verenlerimize aittir. Sana, Uygulamayı kişisel ve ticari olmayan amaçla, kendi cihazlarında kullanman için devredilemez, münhasır olmayan bir lisans veriyoruz.

7. Hizmetin değişmesi ve kesintiler

Uygulamayı geliştirirken oyunları, özellikleri ya da içerikleri değiştirebilir, bazılarını kaldırabiliriz. Sunucu bakımı, bağlantı sorunları ya da elimizde olmayan nedenlerle hizmet kesintiye uğrayabilir; bu durumda devam eden bir oyun kaybolabilir. Plus’ın ücretli içeriğini önemli ölçüde azaltırsak bunu önceden duyururuz.

8. Sorumluluk

Uygulama “olduğu gibi” sunulur. Kanunun izin verdiği ölçüde, dolaylı zararlardan ve kaybolan oyun ilerlemesinden sorumlu değiliz. Kasıt ve ağır ihmalden doğan sorumluluğumuz ile tüketici mevzuatından doğan zorunlu hakların saklıdır.

9. Hesabın kapatılması

Bu koşulları ciddi biçimde ya da tekrar tekrar ihlal edersen hesabını askıya alabilir ya da kapatabiliriz. Mümkünse önce seni uyarırız. Hesabın kapatılırsa aktif Plus aboneliğini App Store’dan iptal etmen gerekir; haksız bir kapatmada iade için bize yazabilirsin.

10. Apple ile ilgili hükümler

Uygulamayı App Store’dan indirdiysen: bu koşullar Apple ile değil, seninle bizim aramızdadır; Uygulamadan ve içeriğinden Apple değil biz sorumluyuz. Apple’ın Uygulama için bakım ve destek yükümlülüğü yoktur. Uygulama bir garantiye uymazsa Apple’a bildirebilirsin; Apple, varsa, ödediğin satın alma bedelini iade eder ve kanunun izin verdiği ölçüde başka bir garanti yükümlülüğü yoktur. Uygulamayla ilgili ürün sorumluluğu, mevzuata uygunluk ve fikri mülkiyet ihlali iddialarını Apple değil biz ele alırız. Uygulamayı kullanırken üçüncü kişi hizmetlerinin (ör. Apple, Google) koşullarına da uyman gerekir. Apple ve bağlı şirketleri bu koşulların lehtar üçüncü kişileridir ve bu koşulları sana karşı uygulayabilir. Ayrıca Apple’ın Standart Lisans Sözleşmesi de geçerlidir; çelişki hâlinde bu koşullar önceliklidir.

11. Uygulanacak hukuk

Bu koşullara Türk hukuku uygulanır. Tüketici olarak başvurularında yerleşim yerindeki tüketici hakem heyetleri ve tüketici mahkemeleri yetkilidir. Başka bir ülkede yaşıyorsan, o ülkenin tüketiciyi koruyan zorunlu kurallarından doğan hakların saklıdır.

12. Değişiklikler ve iletişim

Bu koşulları değiştirirsek güncel hâlini bu sayfada yayımlar, önemli değişikliklerde uygulamada da haber veririz. Değişiklikten sonra kullanmaya devam etmen yeni koşulları kabul ettiğin anlamına gelir. Soruların için: [email protected]

1. Parties and acceptance

These terms are between Berkay Özgeldi (“we”), who provides the Miniq Games mobile app (the “App”), and you. By using the App or creating an account you accept these terms and our Privacy Policy.

2. The service

Miniq Games offers party games played face to face in the same room (e.g. Vampire Village, Tip of the Tongue, Defuse the Bomb, Batak, Backgammon, Harbor Clash). You can play as a guest or with an account. Most games need an internet connection and our servers to work.

3. Your account

• You must be at least 13 years old to create an account.
• Your username is unique and cannot be changed later. You may not use someone else’s name, brand names, or names that are insulting, hateful or obscene; we may ask you to change such a name or close the account.
• You are responsible for keeping your sign-in details safe. Write to us if you think your account is being used without permission.
• You can delete your account at any time under Settings → Delete account.

4. Rules of use

You agree not to:

• harass, threaten or insult others through display names or in games;
• cheat, try to access a game’s secret information, overload our servers, try to guess room codes, or bypass security measures;
• reverse engineer, copy or commercially distribute the App except where the law allows it;
• use the App for any unlawful purpose.

The games are built on face-to-face discussion; you are responsible for how you behave in a room.

5. Miniq Games Plus

• What it offers: Plus is an optional subscription that unlocks extra content in some games (e.g. extra levels in Defuse the Bomb, extra categories in Tip of the Tongue). Nothing from the free version is moved behind Plus. The content Plus covers may grow or change over time.
• Rooms: if a room is created by someone with Plus, everyone in that room plays with Plus content.
• Plan and price: Plus is a yearly auto-renewing subscription. The current price is shown in the App Store before you buy.
• Free trial: new subscribers can use a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, the subscription starts and the yearly price is charged.
• Auto-renewal: payment is charged to your Apple ID account when you confirm the purchase. The subscription renews automatically for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period; the renewal is charged within the 24 hours before the period ends.
• Cancellation: you can manage and cancel your subscription under App Store → Subscriptions. After cancelling, Plus stays active until the end of the paid period. Deleting your account does not cancel the subscription.
• Refunds: purchases are processed by Apple; refund requests are handled under Apple’s rules at reportaproblem.apple.com. Your statutory consumer rights are not affected.
• Account required: Plus is tied to your account and cannot be bought as a guest. On another device, sign in with the same account and use “Restore purchases”.

6. Intellectual property

The App, games, artwork, sounds, texts and card content belong to us or our licensors. We grant you a non-transferable, non-exclusive licence to use the App on your own devices for personal, non-commercial purposes.

7. Changes and interruptions

As we develop the App we may change games, features or content, or remove some of them. The service may be interrupted by server maintenance, connection problems or causes outside our control; a game in progress may then be lost. If we significantly reduce Plus’s paid content, we will announce it in advance.

8. Liability

The App is provided “as is”. To the extent permitted by law, we are not liable for indirect damages or lost game progress. Our liability for intent and gross negligence, and your mandatory consumer rights, remain unaffected.

9. Account termination

If you seriously or repeatedly break these terms, we may suspend or close your account, warning you first where possible. If your account is closed, you need to cancel any active Plus subscription in the App Store; if you believe the closure was unjustified, write to us about a refund.

10. Apple-specific terms

If you downloaded the App from the App Store: these terms are between you and us, not Apple, and we, not Apple, are responsible for the App and its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for handling any product liability, legal compliance or intellectual-property claims relating to the App. You must also comply with applicable third-party terms (e.g. Apple, Google) when using the App. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple’s Standard License Agreement also applies; where they conflict, these terms prevail.

11. Governing law

These terms are governed by Turkish law. As a consumer in Türkiye, the consumer arbitration committees and consumer courts of your place of residence have jurisdiction. If you live in another country, the mandatory consumer-protection rules of that country continue to apply to you.

12. Changes and contact

If we change these terms, we will publish the new version on this page and, for significant changes, also tell you in the App. Continuing to use the App after a change means you accept the new terms. Questions: [email protected]

1. Parteien und Zustimmung

Diese Bedingungen gelten zwischen Berkay Özgeldi („wir“), Anbieter der mobilen App Miniq Games (die „App“), und dir. Mit der Nutzung der App oder dem Erstellen eines Kontos akzeptierst du diese Bedingungen und unsere Datenschutzerklärung.

2. Der Dienst

Miniq Games bietet Partyspiele, die gemeinsam im selben Raum gespielt werden (z. B. Vampirdorf, „Auf der Zunge“, Bombe entschärfen, Batak, Backgammon, Hafenduell). Du kannst als Gast oder mit Konto spielen. Die meisten Spiele benötigen eine Internetverbindung und unsere Server.

3. Dein Konto

• Für ein Konto musst du mindestens 13 Jahre alt sein.
• Dein Benutzername ist eindeutig und kann später nicht geändert werden. Du darfst keine fremden Namen, Markennamen oder beleidigenden, hasserfüllten oder obszönen Namen verwenden; wir können dich bitten, einen solchen Namen zu ändern, oder das Konto schließen.
• Du bist dafür verantwortlich, deine Anmeldedaten zu schützen. Schreib uns, wenn du glaubst, dass dein Konto ohne Erlaubnis genutzt wird.
• Du kannst dein Konto jederzeit unter Einstellungen → Konto löschen entfernen.

4. Nutzungsregeln

Du verpflichtest dich, Folgendes zu unterlassen:

• andere über Anzeigenamen oder im Spiel zu belästigen, zu bedrohen oder zu beleidigen;
• zu schummeln, auf geheime Spielinformationen zuzugreifen, unsere Server zu überlasten, Raumcodes zu erraten oder Sicherheitsmaßnahmen zu umgehen;
• die App zurückzuentwickeln, zu kopieren oder kommerziell zu verbreiten, soweit das Gesetz es nicht erlaubt;
• die App für rechtswidrige Zwecke zu nutzen.

Die Spiele leben von der Diskussion von Angesicht zu Angesicht; für dein Verhalten im Raum bist du selbst verantwortlich.

5. Miniq Games Plus

• Leistung: Plus ist ein optionales Abo, das in einigen Spielen zusätzliche Inhalte freischaltet (z. B. weitere Level in Bombe entschärfen, weitere Kategorien in „Auf der Zunge“). Nichts aus der kostenlosen Version wird hinter Plus verschoben. Der Umfang von Plus kann sich mit der Zeit erweitern oder ändern.
• Räume: Erstellt jemand mit Plus einen Raum, spielen alle in diesem Raum mit Plus-Inhalten.
• Laufzeit und Preis: Plus ist ein jährliches, sich automatisch verlängerndes Abo. Der aktuelle Preis wird vor dem Kauf im App Store angezeigt.
• Kostenloser Test: Neue Abonnenten können Plus 7 Tage kostenlos testen. Wenn du nicht spätestens 24 Stunden vor Ende des Tests kündigst, beginnt das Abo und der Jahrespreis wird berechnet.
• Automatische Verlängerung: Die Zahlung wird bei Bestätigung des Kaufs über deine Apple-ID abgerechnet. Das Abo verlängert sich automatisch um dieselbe Laufzeit zum dann gültigen Preis, sofern es nicht spätestens 24 Stunden vor Ende des Zeitraums gekündigt wird; die Verlängerung wird innerhalb der letzten 24 Stunden vor Ablauf berechnet.
• Kündigung: Du kannst das Abo unter App Store → Abonnements verwalten und kündigen. Nach der Kündigung bleibt Plus bis zum Ende des bezahlten Zeitraums aktiv. Das Löschen deines Kontos kündigt das Abo nicht.
• Erstattungen: Käufe wickelt Apple ab; Erstattungen richten sich nach Apples Regeln unter reportaproblem.apple.com. Deine gesetzlichen Verbraucherrechte, einschließlich eines etwaigen Widerrufsrechts, bleiben unberührt.
• Konto erforderlich: Plus ist an dein Konto gebunden und kann nicht als Gast gekauft werden. Auf einem anderen Gerät meldest du dich mit demselben Konto an und nutzt „Käufe wiederherstellen“.

6. Geistiges Eigentum

Die App, die Spiele, Grafiken, Töne, Texte und Karteninhalte gehören uns oder unseren Lizenzgebern. Wir räumen dir eine nicht übertragbare, nicht ausschließliche Lizenz ein, die App auf deinen eigenen Geräten für private, nicht kommerzielle Zwecke zu nutzen.

7. Änderungen und Unterbrechungen

Bei der Weiterentwicklung der App können wir Spiele, Funktionen oder Inhalte ändern oder entfernen. Der Dienst kann durch Wartung, Verbindungsprobleme oder Ursachen außerhalb unserer Kontrolle unterbrochen werden; ein laufendes Spiel kann dann verloren gehen. Wenn wir die kostenpflichtigen Plus-Inhalte wesentlich verringern, kündigen wir das vorher an.

8. Haftung

Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit. Im Übrigen haften wir, soweit gesetzlich zulässig, nicht für mittelbare Schäden oder verlorenen Spielfortschritt. Zwingende Verbraucherrechte bleiben unberührt.

9. Kontosperrung

Wenn du schwer oder wiederholt gegen diese Bedingungen verstößt, können wir dein Konto sperren oder schließen, nach Möglichkeit nach vorheriger Warnung. Wird dein Konto geschlossen, musst du ein aktives Plus-Abo im App Store kündigen; hältst du die Schließung für ungerechtfertigt, schreib uns wegen einer Erstattung.

10. Bestimmungen zu Apple

Wenn du die App aus dem App Store geladen hast: Diese Bedingungen gelten zwischen dir und uns, nicht Apple; für die App und ihre Inhalte sind wir verantwortlich, nicht Apple. Apple ist nicht zu Wartung oder Support der App verpflichtet. Entspricht die App nicht einer Gewährleistung, kannst du Apple benachrichtigen; Apple erstattet dann ggf. den Kaufpreis und hat, soweit gesetzlich zulässig, keine weitere Gewährleistungspflicht. Für Produkthaftungs-, Rechtskonformitäts- und Schutzrechtsansprüche im Zusammenhang mit der App sind wir zuständig, nicht Apple. Bei der Nutzung musst du auch die Bedingungen von Drittanbietern (z. B. Apple, Google) einhalten. Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser Bedingungen und können sie dir gegenüber durchsetzen. Ergänzend gilt Apples Standard-Lizenzvertrag; bei Widersprüchen haben diese Bedingungen Vorrang.

11. Anwendbares Recht

Es gilt türkisches Recht. Wenn du als Verbraucher in einem anderen Land lebst, bleiben die zwingenden Verbraucherschutzvorschriften deines Wohnsitzlandes anwendbar, und du kannst dort klagen. Die EU-Plattform zur Online-Streitbeilegung wurde eingestellt; zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle sind wir nicht verpflichtet und nicht bereit.

12. Änderungen und Kontakt

Wenn wir diese Bedingungen ändern, veröffentlichen wir die neue Fassung auf dieser Seite und informieren dich bei wesentlichen Änderungen auch in der App. Nutzt du die App nach einer Änderung weiter, gelten die neuen Bedingungen. Fragen: [email protected]
